Applicants should first check the instructions and any specific requests for their visa category.

It is easy to assume that preparation is complete once the records have been obtained and translated into English.
However, without understanding the procedure that produced the Korean disposition, even fluent English can convey the wrong procedural meaning.

In particular, the Korean disposition commonly translated as “suspension of indictment” is a discretionary decision by a prosecutor not to bring charges. In this article, it is described as “discretionary non-prosecution.” It is distinct from a court conviction and does not itself mean an acquittal or a finding that no offense occurred.
Equating it with a different U.S. procedure, or failing to distinguish the allegations from the final disposition, can confuse the reader about what happened.

This is why an accurate understanding of the facts and procedure matters from the first stage of translation preparation.
Recent U.S. precedent illustrates that the contents of a record and an applicant’s own statements may have different legal significance.

“My case ended in discretionary non-prosecution. How might it be understood in a U.S. visa application?”
“If the case does not appear on my certificate, can it still matter at the interview?”

These questions also help explain the distinctions that should be preserved when Korean records are translated into English.

What happened in the recent decision?

On September 22, 2026, the Board of Immigration Appeals (BIA) issued Matter of Mendez Maldonado .

The applicant, who sought adjustment of status in the United States, acknowledged past possession and use of cocaine in an interview and related statements.
The issue was drug-related inadmissibility based on the applicant’s admissions, rather than on a criminal conviction.

The applicant challenged the admissions because the officer had not first explained the precise legal definition and essential elements of the offense.
The BIA held that this advance explanation was not invariably required and overruled the earlier precedent imposing that requirement.

This decision did not directly address a Korean discretionary non-prosecution disposition.
However, a footnote expressly states that its admission analysis applies not only to controlled-substance offenses but also to CIMTs.

Full decision: Matter of Mendez Maldonado, 30 I&N Dec. 62 (BIA 2026)

What is a CIMT, and how does discretionary non-prosecution relate to it?

CIMT means “crime involving moral turpitude,” a classification used in U.S. immigration law.
Fraud and theft frequently raise CIMT issues, but an offense label alone does not determine the result in every case.

The relevant questions include what conduct the statute criminalizes and what elements, such as intent, are required.
A small fine or lenient treatment in Korea does not, by itself, resolve whether an offense is a CIMT.

Korean discretionary non-prosecution is a prosecutor’s decision not to institute a prosecution and is distinct from a court conviction.
It should not automatically be equated with a U.S. court procedure that defers adjudication of guilt.

In U.S. visa screening, however, the existence of a conviction and an admission to conduct constituting an offense can be separate issues.
The disposition and the underlying conduct therefore need to be understood separately.

This does not mean that every discretionary non-prosecution case involves a CIMT or adversely affects a U.S. visa application.
It means that the disposition label alone does not answer every question.

Does saying “I received discretionary non-prosecution” automatically admit a crime?

No.

Describing the fact that a prosecutor issued a discretionary non-prosecution disposition is not the same as admitting the conduct necessary to establish a particular offense.

An “admission” under U.S. immigration law does not encompass every statement acknowledging that a case existed.
The analysis considers the offense concerned, whether the facts admitted establish its essential elements, and whether the admission was voluntary.

Nevertheless, specific statements made while explaining the events can have independent legal significance.
Applicants should be cautious about assuming that interview answers are unimportant simply because there was no conviction.

Although this was an adjustment-of-status case within the United States, it concerns inadmissibility provisions that are also relevant to visa applications in Korea.
Its relevance should therefore be considered without assuming that the decision has changed every interview practice at the U.S. Embassy in Seoul.

If the case is absent from the record, does honesty put me at a disadvantage?

The answer should not depend solely on whether a case appears on the certificate.
In the application and interview, what the question actually asksmust be understood first.

A question about an arrest or conviction may have a different scope from a question about particular conduct or a violation of law.
A discretionary non-prosecution disposition does not justify answering every question automatically with either “Yes” or “No.”

Questions must be answered truthfully, accurately, and completely.
At the same time, applicants need not speculate about uncertain memories, admit conduct that did not occur, or agree to legal terminology they do not understand.

If a question is unclear, clarification should be requested.
An accurate explanation of the facts is different from concealing or minimizing facts responsive to the question.

Truthful answers do not always guarantee visa approval.
The actual conduct and statements may establish inadmissibility, in which case any applicable exception or waiver must be considered.

False answers, however, can create an additional problem separate from the original incident.
The lesson from this decision is to distinguish what appears on the record, what the disposition means, and what the applicant’s statements convey.

How do visitor, student, and employment visas differ from marriage-based immigrant visas?

In both settings, the underlying case, CIMT issues, and the legal significance of admissions are initial considerations.
If criminal inadmissibility is established, the available next steps differ.

For ordinary nonimmigrant visas, including visitor, student, and employment visas,a waiver process involving a consular or other authorized recommendation and review by U.S. Customs and Border Protection (CBP) may be relevant.
The purpose of travel, seriousness of past violations, and risk associated with admission are important considerations.

For marriage-based immigrant visas such as CR-1 and IR-1,a criminal inadmissibility waiver using Form I-601 may be relevant where the statutory requirements are met.
Having a U.S. citizen spouse does not itself establish eligibility. The applicable statutory requirements, including qualifying hardship or the rehabilitation route for sufficiently old conduct, must be considered.

The preparation needed for the same Korean disposition can therefore differ by visa category.
However, discretionary non-prosecution does not automatically require a waiver application. The initial issue is whether inadmissibility is actually established.

Nonimmigrant waiver procedures: 9 FAM 305.4
Immigrant waiver provisions: INA §212(h)

What should be preserved when the translation is first prepared?

Documents concerning discretionary non-prosecution may require more than replacing Korean words with English words.
Korean and U.S. criminal procedures differ.

For example, describing a Korean prosecutor’s decision in language associated with a U.S. court’s deferred adjudication can misrepresent both the decision-maker and the procedure.
The translation should faithfully convey the original so that the reader can identify who made the decision and what disposition was issued.

Points to preserve in the translation include:

Distinguishing the allegations from the final disposition

Distinguishing a prosecutor’s disposition from a court judgment

Accurately reproducing dates, case numbers, and statutory references

Avoiding admissions of guilt or legal conclusions not found in the source

Using names and case-related terminology consistently across documents

Discretionary non-prosecution, deferred sentencing, and suspension of execution of a sentence are different procedures.
Understanding these distinctions helps preserve the nature of the disposition and the procedural context in translation.

The translation does not itself determine whether the case involves a CIMT or whether a visa can be issued.
Faithfully translating a source document is distinct from applying U.S. law to reach a conclusion in an individual case.

Start with an accurate presentation of the record

Whether a case has concluded in Korea, whether it appears on a certificate issued for submission, and what it means in U.S. visa screening are different questions.
Recent precedent demonstrates why these distinctions matter.

Document preparation should therefore be understood as an initial step in accurately conveying the disposition and procedure, rather than simply converting a Korean record into English.
The translation should distinguish allegations from the final disposition and prosecutorial decisions from court judgments, without adding admissions or conclusions absent from the original.

PATH focuses on faithfully preserving these distinctions in translation, informed by an understanding of legal documents and differences between Korean and U.S. systems.
Understanding the document’s context from the record-gathering and translation stage helps prevent a Korean disposition from being mistaken for a different procedure.

Accurate translation does not guarantee a visa outcome. It provides a foundation for faithfully conveying the facts contained in the original.

General information notice

This article provides general information about publicly available U.S. laws, decisions, and related documents.
